Legal guarantee of conformity
If the purchaser is a consumer, i.e., a natural person purchasing for purposes NOT related to their commercial or professional activity, Gasperoni Andrea, sole proprietorship, is liable for any lack of conformity pursuant to Legislative Decree 206/2005, to which reference is made. For the purposes of this contract, consumer goods are presumed to be in conformity with the contract if, where applicable, the following circumstances coexist: a) they are suitable for the use for which goods of the same type are normally used; b) they conform to the description given by the seller and possess the qualities of the goods held out to the consumer as a sample or model by the seller; c) they exhibit the quality and performance that are normal in goods of the same type and which the consumer can reasonably expect, given the nature of the goods and, where applicable, public statements about the specific characteristics of the goods made by the seller, the manufacturer, or their agent or representative, particularly in advertising or on labeling; d) they are also suitable for the particular use desired by the consumer and which was made known to the seller at the time of entering into the contract and which the seller has accepted, even by conclusive facts. For the purposes of the product description, the seller Gasperoni Andrea, sole proprietorship, expressly specifies the following: a) the products sold are to be used exclusively on racing vehicles where permitted by the regulations; b) the products sold are in no way approved for road use; c) the products sold must not, under any circumstances, be installed for the purpose of replacing original parts on road vehicles; d) the sole prerogative and objective of the products sold is, in fact, to be understood exclusively as a limited improvement in the performance of the car during regular sports competitions; e) the use of the products sold, the durability of which cannot be guaranteed, leads, for example, to a reduced lifespan of all other car components, increased noise, increased vibrations, increased fuel consumption, etc.; f) it is emphasized that the use of the products sold on vehicles can create stresses or problems that can be very serious and difficult to predict, often also linked to the different possible installation methods. In light of this description, except for rare and limited exceptions due to obvious manufacturing defects immediately apparent upon delivery, it is therefore not possible to provide any warranty for the products distributed and sold by Gasperoni Andrea ditta individuale, nor to guarantee compatibility with other mechanical components of the vehicle on which they are mounted. The purchaser and/or user, having inspected the aforementioned components, is therefore solely responsible for deciding how and where to use them in accordance with their careful design and thus assumes all risks, including any potential loss of profits or sales, losses, costs of replacement goods or services, business interruptions, damage to property, persons, or animals, or any direct, indirect, incidental, or financial damages that may arise. In the event of a lack of conformity, the purchaser may request repair or replacement of the purchased item. The request must be submitted in writing to Gasperoni Andrea ditta individuale, who will indicate their willingness to comply with the request or the reasons preventing them from doing so. Materials sent to manufacturers or service providers for repairs, treatments, or replacements under warranty are shipped at the customer's risk and expense. All Gasperoni Andrea ditta individuale products are identifiable by their logos and serial numbers. Altering or removing these markings by the retailer/user will void any warranty claims by Gasperoni Andrea ditta individuale. In cases where the provisions of Legislative Decree 206/2005 – Consumer Code do not apply because the purchaser is not a consumer, Articles 1490 et seq. of the Civil Code apply regarding warranties for defects in the item sold. Specifically, in relation to the provisions of Articles 1490 and 1491 of the Civil Code, the warranty for defects in the item sold is excluded.
Right of Withdrawal
As provided by current legislation regarding distance contracts, if the buyer is a natural person making the purchase for purposes NOT related to any commercial or professional activity, they have the right to withdraw from the contract within 14 (fourteen) business days from the day on which the buyer or a third party other than the carrier and the buyer designated by them acquires physical possession of the goods. Before the expiration of this period, the consumer wishing to exercise the right of withdrawal must notify Gasperoni Andrea ditta individuale in writing. The consumer must return the goods without undue delay and, in any case, within fourteen days of the date on which they communicated their decision to withdraw from the contract. The direct cost of returning the goods is borne by the consumer. Goods must be returned free of any manipulation that would reduce their value (equal to new, suitable for resale, and uninstalled). Otherwise, the consumer will be held liable for the diminished value of the goods. Exceptions: The right of withdrawal is subject to all exceptions set forth in Article 59 of Legislative Decree 206/2005. In particular, the right of withdrawal does not apply in the following cases: - for the supply of goods constructed and packaged to measure, based on the consumer's specifications and specific needs, or otherwise personalized, as is customary. Therefore, the customer may not withdraw from the contract if the goods were specifically manufactured for the customer, even through agreements made by telephone or email; - the right of withdrawal does not apply to the supply of goods whose price is dependent on fluctuations in the financial market beyond the control of Gasperoni Andrea, sole proprietorship, and which may occur during the withdrawal period. No right of withdrawal is foreseen if the provisions of Legislative Decree no. 206/2005 Consumer Code are not applicable, as the buyer does not have the status of consumer.
